Is an arrest record going to be a permanent part of my criminal history?
An arrest doesn’t have to be on your record. Those who are acquitted or have their charges dropped are entitled to apply for removal of the record, which can remove all traces of the arrest and any related judicial proceedings. Additionally, by filing a Motion for Return of Fingerprints, one can take further steps to clear their record, removing any hint of the arrest.
Can I have probation as an alternative to jail time for a misdemeanor or felony?
Probation is not a right, but rather a discretionary alternative considered by the court in Michigan. It may be granted if you're viewed as a non-threat to the public and if the judge decides that incarceration is not required. Probation terms are designed to be comprehensive and demanding.
What does it mean if I am under investigation but haven't been charged?
It means the police are currently gathering evidence. Once the investigation is complete, the prosecutor will review the evidence and determine whether to file charges. The police contribute to the investigation, but the decision to charge someone is ultimately up to the prosecutor.

A: A DUI conviction remains on your record permanently. The conviction itself will indefinitely stay on your criminal record, regardless if it is a misdemeanor or a felony. Although there might be a possibility to expunge a first-offense violation, those with two or more convictions cannot file for expungement. Additionally, the application for expungement can only be put forward five years following the end of the probationary period for the first violation.
Q: Can I challenge a DUI charge even if my blood alcohol concentration was more than 0.08%?
A: Yes, it is still possible to challenge a DUI charge. For example, if the police officer didn't have probable cause for the traffic stop, the case can be contested. Likewise, if the police didn't strictly comply with rules and regulations during breath and blood alcohol testing, the results may be considered inadmissible as evidence.
Q: What are the consequences of refusing a chemical test in Oakland County?
A: Refusing a chemical test in Oakland County may result in a suspension of your license for one year under the implied consent law, with a temporary DI-93 permit potentially issued for the first 14 days. If the suspension is contested and lost at a Secretary of State hearing, the full suspension is implemented. However, there's an option to appeal against this ruling.

What sorts of sobriety tests are done during a DUI stop?
In a DUI stop, you may have to take several sobriety tests. Field sobriety tests could involve activities like counting backward, walking a straight line, or standing on one leg. Additionally, you might be subjected to chemical tests like a preliminary breath test (PBT) or a blood test. Occasionally, a urine test could be requested.
How does one restore a driver's license after a DUI?
If your license was suspended, it gets reinstated after the penalty period. However, for revoked licenses, you need to reapply through the Office of Hearings and Administrative Oversight (OHAO), the Driver’s License Appeals Division (DLAD), or Driver’s Assessment Appeals (DAAD). If the DLAD/DAAD decision is unsatisfactory, you can appeal to the circuit court.
How long is a DUI kept on your record?
A DUI conviction remains on your record indefinitely. While DUIs typically fall off your Driving Record over time, 1st and 2nd Offense DUIs are classified as misdemeanor crimes, and a 3rd Offense is a felony. As criminal convictions, these offenses remain permanently on your Criminal Record. Hence, a DUI conviction will lead to a Criminal Record if you don't already have one, and DUIs cannot be expunged from your record.
